SECTION 1 – OVERVIEW, ELIGIBILITY, & GEOGRAPHIC EXCLUSIONS

1.1 Corporate Framework and Hosting Environment

Welcome to The Battle Master's Armory ("the Company"). Throughout this platform, the terms "we", "us" and "our" refer strictly to The Battle Master's Armory. The Company operates this e-commerce infrastructure and storefront website, including all related digital information, source content, user features, interactive tools, product catalogs, and commercial services in order to provide you, the customer, with a curated shopping experience (collectively, the "Services"). The Company's global digital architecture is powered by Shopify, which provides the hosting environment, secure shopping cart, and transaction pipelines that enable us to deliver our Services to you. By visiting, browsing, interacting with, or purchasing from our Services, you explicitly agree to be bound by these Terms of Service ("Terms," "Agreement") and our Global Privacy Policy. If you do not completely agree to these Terms, you possess no legal right to use, browse, or access our Services.

1.2 Age Eligibility (18+ Policy Mandate)

You must be at least 18 years of age, or the legal age of majority in your specific country, state, or provincial jurisdiction, to browse our store, create an account, or purchase any retail product. By completing a transaction, you certify under penalty of contract violation that you meet this requirement, possess the full civil capacity to enter into a binding consumer agreement, and are the explicitly authorized user of the payment method provided. Any age confirmation data collected via our checkbox gates is permanently logged alongside your connection metrics for compliance enforcement.

1.3 Geographic Sales Exclusions (Surgical Germany Exclusion)

In accordance with our cross-border regulatory compliance protocols and legal risk vectors, the Company strictly prohibits and blocks all sales, billing registration, customer account creation, and logistics shipping routes to Germany. Any orders routing to this destination or initializing from IP addresses mapped to Germany will be automatically intercepted by our backend system, canceled immediately, and refunded minus standard merchant terminal transaction fees.

SECTION 2 – ACCOUNT SECURITY & DATA ACCURACY

By utilizing the Services, you agree to provide current, complete, and accurate purchase, payment, and account information for all transactions executed at our store. You agree to promptly update your account and other information, including your email address, credit card numbers, tokenized payment forms, and expiration dates, so that we can complete your transactions and contact you as needed. You are solely responsible for maintaining the absolute security of your account credentials, account passwords, and for all actions occurring under your session signature. Customer profiles or sessions found utilizing Virtual Private Networks (VPNs), data center proxies, or TOR browsers to spoof geolocations or intentionally bypass geographic pricing blocks or country restrictions will be permanently terminated without prior notice.

SECTION 3 – PRODUCTS, AMENITIES, & WARRANTY LIMITATIONS

We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors, structural presentation, or product appearance may differ from how they appear on your physical screen due to the type of device you use to access the store and your specific device display settings. All descriptions of products, technical attributes, and retail lists are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region, or jurisdiction, on a case-by-case basis. Except as explicitly outlined under the regional consumer safety laws of specific target destinations (such as the Australian Consumer Law guarantees or the New Zealand Consumer Guarantees Act), all products are provided on an "AS IS" and "AS AVAILABLE" basis without implied merchantable quality warranties or fitness for a particular purpose.

SECTION 4 – ORDERS AND PAYMENTS

When you place an order, you are making a binding commercial offer to purchase. The Battle Master's Armory reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until the Company confirms acceptance via email. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as we are unable to accommodate cancellation or modification requests after an order is accepted. You represent and warrant that (I) the credit card information you provide is true, correct, and complete, (II) you are duly authorized to use such credit card for the purchase, (III) charges incurred by you will be honored by your credit card company, and (IV) your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 5 – ORDER LIMITS & TRANSACTION VELOCITY PROTECTION

To maintain platform security, prevent fraudulent transactions, and ensure strict compliance with international shipping and customs regulations, The Battle Master's Armory reserves the right to enforce the following per-transaction limits:

• Maximum order value of $1,000 USD per transaction.

• Maximum of 5 items per individual order.

• Maximum of 3 units of any item priced at $300 USD or above per order.

Orders that exceed these velocity limits may be automatically held for review or cancelled at our sole discretion. In the event of a cancellation, a full refund will be issued to the original payment method. To complete a purchase exceeding these limits, customers must place multiple separate orders. By completing a purchase on this website, you acknowledge and agree to these transaction limits.

SECTION 6 – MYSTERY BOX REGIONAL RESTRICTIONS & EXCLUSIONS

Due to applicable local laws and regulations governing randomized product sales, Mystery Box products are strictly prohibited from sale, shipment, or delivery to the following jurisdictions:

• United States: Hawaii (HI), Washington (WA), Idaho (ID).

• International: Belgium (BE), Netherlands (NL).

Any order containing a Mystery Box product placed by a customer residing in, billing from, or shipping to any of the above jurisdictions will be automatically cancelled and fully refunded. This policy applies regardless of the shipping destination provided at checkout. The Battle Master's Armory reserves the right to expand this list of restricted regions at any time without prior notice to reflect changes in applicable law. By purchasing a Mystery Box product, you represent and warrant that you are not located in, do not reside in, and are not placing the order from any restricted jurisdiction listed above.

SECTION 7 – INTERNATIONAL SHIPPING & IMPORT TAXES (DAP INCOTERMS)

All international orders are fulfilled and dispatched directly from our overseas manufacturing facilities. All cross-border transactions are processed strictly under DAP (Delivered at Place) parameters:

7.1 Free Transit Promotion: We are proud to offer 100% Free International Shipping on all orders. Your checkout total covers the full cost of the product and international transit to your doorstep.

7.2 Doorstep Fees Exclusion: Your checkout total strictly excludes local value-added taxes (VAT/GST), import duties, regional customs tariffs, and delivery carrier advancement fees. These are statutory government charges enforced by your home country.

7.3 The Collection Process: When your package arrives at your national border, your local postal service or private courier (such as Canada Post, DHL, FedEx, Royal Mail, Swiss Post, or Posten Norge) will hold the item and contact you directly via text message or email with a secure link to settle these outstanding customs charges before delivering the package to your door. Tracking and paying these localized border assessments is your sole financial responsibility.

7.4 Package Abandonment & Refusal: If a shipment is held at a border checkpoint and you refuse to settle the destination taxes or fail to respond to the delivery carrier's notifications within the carrier’s specified timeframe, the carrier will flag the package as "Abandoned" or "Refused." Abandoned packages are destroyed at the border by customs authorities. In the event of customer package refusal or abandonment, the transaction is considered legally fulfilled, the customer completely forfeits the product ownership, and no refunds or replacement shipments will be issued.

7.5 Dispute Waiver: The Buyer explicitly agrees that unexpected localized import fees or carrier surcharges do not constitute valid grounds for a "Significantly Not as Described," "Unapproved Fee," or "Package Not Received" chargeback dispute with their credit card processor or bank.

SECTION 8 – PROHIBITED USES & INTELLECTUAL PROPERTY RIGHTS

8.1 Proprietary Ownership

Our Services, storefront channels, interactive layouts, digital applications, and underlying assets—including but not limited to all text displays, registered or unregistered trademarks, company brand names, commercial designs, photographic images, graphic assets, product descriptions, video elements, audio files, and the strategic selection and arrangement thereof—are the exclusive property of The Battle Master's Armory, its corporate affiliates, or its licensors. All rights are fully protected under United States and international patent, copyright, trademark, trade secret, and other intellectual property or proprietary rights laws.

8.2 License Restrictions and Automation Bans

You are explicitly prohibited from reproducing, distributing, copying, reverse-engineering, modifying, mirroring, or scraping any of our proprietary materials for commercial use or distribution. You are strictly barred from using our Services, network pipelines, or storefront servers for any unlawful actions, system harassment, or the transmission of destructive malware. You are comprehensively prohibited from deploying automated data scrapers, electronic harvesting spiders, inventory bots, programmatic scraping scripts, or advanced artificial intelligence tools (including agentic AI agents, autonomous web agents, or LLM-driven query automation systems) on our platform without our prior, explicit written consent. We reserve the absolute right to suspend, lock, or permanently terminate your customer profile, IP path, and checkout access without notice if we determine, in our sole discretion, that you have violated any part of these restrictive parameters.

SECTION 9 – GLOBAL MYSTERY BOX TERMS, REPLACEMENT PROTOCOLS, & EUROPEAN EXEMPTIONS

9.1 Global Final Sale Framework

All retail purchases of mystery boxes, blind boxes, or randomized consumer surprise items (collectively, "Mystery Boxes") executed across our standard global lanes (including the United States, Canada, Australia, New Zealand, Japan, and Thailand) are strictly and permanently final sale. Because these items feature a randomized selection of internal elements, the Company does not accept returns, exchanges, partial modifications, or change-of-mind refunds based on personal preference, style variations, color dissatisfaction, or aesthetic disappointment with the surprise contents. We explicitly guarantee that the combined baseline retail value of the internal elements will meet or exceed the list price paid at checkout.

9.2 European Statutory Returns & Withdrawal Protocol

In strict compliance with statutory regional consumer protection frameworks across the United Kingdom, Switzerland, Norway, the European Union, and the broader European Economic Area (EEA), the Company will honor a standard 14-day cooling-off right of withdrawal from the physical date of package delivery.

• Because the Company provides 100% Free Shipping at checkout to fully cover your outbound delivery transit, international return freight costs back to our centralized reception hub remain the sole financial responsibility of the buyer.

• To secure a refund under cooling-off parameters, the customer must return the item safely to our centralized reception hub and provide an active cross-border tracking link/number to our support desk.

• Upon physical arrival at our facility, all returned merchandise is subject to a mandatory technical inspection by our intake team to verify it has arrived in completely like-new condition.

• In the event that the inspection flags any noticeable physical damage, scratches, compromised components, or lost, altered, or missing parts and pieces, the transaction will be processed under our Diminished Value Rules. The exact financial cost required to repair the physical damage or replace the missing pieces will be calculated and deducted directly from the final credit balance.

• Once the condition inspection is finalized and approved by our compliance team, the remaining refund balance will be automatically processed back to the customer's original payment method.

9.3 Damaged, Defective, or Incorrect Components Protocol

Our global quality guarantee protects your purchase against genuine manufacturing failures, structural breaks, or order fulfillment errors:

• If an internal component or specific part arrives genuinely broken, shattered, or fundamentally incorrect (e.g., a specific variant part is structurally non-functional or the wrong layout size was packed), you must contact customer support within 7 days of delivery.

• The Buyer must provide clear photographic or video documentation of the specific damaged component alongside the original courier shipping label sent to warranty@battlemastersarmory.com.

• Eligible claims will be resolved via the immediate free replacement of the specific affected part or a partial customer support credit issued from our operational buffers. Minor structural defects or superficial damage to external product packaging do not constitute a product defect and do not qualify for a full order refund. Dissatisfaction with a randomized style choice never constitutes a product defect.

SECTION 10 – FRIENDLY FRAUD & BANK DISPUTE MITIGATION

10.1 Binding Authorization

By completing your transaction, checking our mandatory compliance gates, and initializing our secure checkout loop, you explicitly acknowledge that you understand our product descriptions, international Delivered at Place (DAP) shipping rules, velocity limits, and global final sale return policies. Filing a payment dispute, credit card chargeback, or bank reversal for any successfully fulfilled order ("friendly fraud") constitutes a direct, material breach of this commercial contract.

10.2 Retained Evidence Submission

In the event that an unjustified or fraudulent chargeback is initiated by the buyer (including attempts to claim "Unauthorized Charge" over basic international DAP tax notifications, or "Item Not as Described" over standard randomized mystery box selections), the Company will immediately present this binding Agreement, your digital connection IP address logs, checkbox click history timestamps, customer support email logs, and verified courier direct-signature delivery sheets to your issuing bank, financial merchant gateway, and card network (Visa, Mastercard, American Express, Discover) to successfully reverse the dispute and restore merchant funds.

10.3 Legal Cost Recovery

The Company reserves the absolute right to permanently terminate and ban offending accounts and seek full civil legal recovery of the disputed funds, secondary merchant terminal chargeback penalties, administrative handling overhead, collection agency costs, and all reasonable attorneys' fees directly from the buyer.

SECTION 11 – SEVERABILITY, WAIVER, & CONTRACTUAL HEADINGS

11.1 Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable by an administrative body or court of competent jurisdiction, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be cleanly severed from these Terms. Such determination shall not affect the validity, legality, and enforceability of any other remaining provisions, which shall remain in full force and effect.

11.2 Waiver and Entirety

The failure of us to exercise or enforce any right, provision, or remedy outlined in these Terms of Service shall not constitute a waiver of such right or provision. These Terms, alongside our published Privacy Policy and individual CSV fixed market catalog entries, constitute the entire agreement and commercial understanding between you and us, completely superseding any prior or contemporaneous oral or written agreements, communications, or proposals. Any ambiguities in the final interpretation of these parameters shall not be construed against the drafting party.

11.3 Headings

The structural headings used throughout this agreement are included for layout convenience only and will not limit, define, interpret, or otherwise affect these binding Terms.

SECTION 12 – GOVERNING LAW AND EXCLUSIVE JURISDICTION

These Terms of Service, our storefront policies, and any separate commercial agreements whereby we provide you retail products or digital Services shall be governed by, construed, and enforced in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to conflicts of law principles. You and The Battle Master's Armory explicitly consent to exclusive venue and personal jurisdiction in the federal and state courts located in Cambria County, Pennsylvania, United States, for the resolution of any legal proceedings, civil discovery actions, or contractual arbitrations arising out of this Agreement.
